According to the provisions of the Rajasthan Right to Health Bill, the people of Rajasthan will now be entitled to emergency treatment in private hospitals without any prior payment.  According to the RTH Bill, if the patient is unable to pay the cost of the treatment, then it will be reimbursed by the government.

This “Right to Health Bill” states that no health care provider can delay treatment even on the basis of police clearance or obtaining a police report.

It is being told about this “RTH Bill” that even after having Chiranjeevi card, some private hospitals do not provide treatment to the patients of Chiranjeevi Health Insurance Scheme, so this bill has been brought.

According to this “Right to Health Bill” implemented in Rajasthan, if a patient comes to a private hospital in the condition of emergency, then in the situation of the patient not having money at that time, the hospital will have to treat the patient for free (without depositing advance).

Apart from this, even later, if the patient does not have the money for the treatment, then the state government will bear all the expenses of the free treatment.  Even after being referred to another hospital, the government will bear all the expenses.  For which a separate fund will be created for free treatment in emergencies in private hospitals.

On receipt of any complaint, a hearing will be held in the authority constituted at the district and state level.

Let us tell you that those who do not follow the provisions of the bill and are found guilty can be fined 10-25 thousand.  This decision cannot even be challenged in a civil court.

In this bill, residents of Rajasthan will get the benefit of free medical services from hospitals and clinics.  After the RTH Bill, government and private hospitals will no longer be able to refuse treatment to patients. That means every person will get guaranteed treatment

  • Along with government hospitals, patients will also be able to get free treatment in private hospitals in case of emergency.  This facility will be available only in those private hospitals which have a capacity of more than 50 beds.
  • Outpatients Department (OPD), indoor admitted patients, doctor’s visit and consultation, medicines, diagnosis, emergency transportation i.e. ambulance facility, procedures and services, all facilities of emergency treatment will be available under the rules of the bill.
  • The government will get the Health Insurance of every person of the state done at its own level.
  • The patient and his family members will get information about the treatment given by the doctors whenever they want.
  • In case of emergency, private hospitals will provide immediate treatment without any fees or charges. In this, if referral has to be made after first aid, then an ambulance will also be made available.
  • If there is a medico-legal issue, then the health care provider will not be able to delay the treatment on the basis of NOC from the police or police report.
  • The treatment of diseases occurring during any kind of epidemic is also covered under this law.
  • If the patient dies in the hospital during treatment, then no hospital will be able to stop the dead body in the hospital on the pretext of payment.
  • It will be the responsibility of the hospital to refer a patient to another hospital in critical condition.
  • Consent will be taken from the patient or his relatives by giving advance information about surgery, chemotherapy.
  • The presence of a woman will be necessary during the physical test of a female patient by a mail worker.
  • Will get the right to get information about the rate and tax of every type of service and facility. However, the government will make the payment under the Chiranjeevi scheme.
  • Patient’s illness will not be made public by private hospitals. Only the patients and their relatives can be informed.
  • Free transportation, free treatment and free insurance cover will be used in road accidents.
  • Under this bill, the patient is exempted from advance payment for treatment in private and government hospitals in emergency.
  • If the patient is unable to pay, then the state government will bear the cost. Even after being referred to another hospital, the government will bear all the expenses.
  • Government and non-government hospitals and doctors will not be able to get away with providing free treatment to emergency patients. Even in medico-legal cases, they will have to be treated immediately without police approval.
  • Apart from the emergency case, the patient can choose the lab and medicine shop as per his convenience and wish, which means the web of commission between medicine shops, labs and private hospitals will be broken.
  • If a hospitalized patient wants to consult an outside doctor, then the hospital will have to give all the documents of his treatment in time.
  • In case of violation of any rule, a penalty of Rs 10,000 is proposed, which will be Rs 25,000 for repeated violation.
  • In this bill, some duties have also been prescribed regarding the patients and their relatives. In which patients or their relatives will not be able to misbehave with medical personnel and doctors. Postmortem to be allowed in case of unnatural death.

Why is this RTH bill being opposed?

Doctors allege that through this RTH bill, the government wants to put its responsibilities on the shoulders of private doctors.  Due to this bill, the very existence of private hospitals will be in danger.

This will take away their right to earn a living, then the common people will be deprived of 24-hour medical facilities.

However, the outline of this RTH (Right to Health) Bill is not yet clear. For example, after giving treatment to the patient, how will the government pay for it?

The striking doctors object that when the government is already running many health schemes then what is the need for a separate Right to Health Bill.

Four schemes already exist in the medical sector

Pre-existing plans are also creating confusion on this.

  • The state government increased the facility of free treatment up to Rs 10 lakh to Rs 25 lakh under the Chiranjeevi Health Insurance Scheme in this year’s budget.  In this scheme, the government had paid Rs 1,940 crore between 1 April 2022 and 31 December 2022.
  • The second scheme is for government employees, ministers, former and present legislators.
  • The third ‘Free Nirogi Rajasthan Yojana’ has free medicines, all OPD-IPD and registration facilities in government hospitals.  In this, Rs 1,072 crore was spent from March 2022 to December 2022.
  • Fourth, the free test scheme has the facility of conducting 90 tests free of cost in government hospitals affiliated to medical colleges.

Meaning of ’emergency’ not defined properly according to doctors 

According to doctors, the word ’emergency’ in the Right to Health Bill (RTH Bill) has become the biggest headache.  A provision has been made in the bill that no private hospital can deny treatment to any patient in case of ’emergency’.  If any hospital refuses treatment, the government will take action against them.

Private hospital doctors say how can the referring doctor guarantee that the patient will not die in a critical condition.  Due to this provision, quarrels will increase between the private hospital and the family members and they will have to go to court.
