Many types of laws have been made in India. These laws are applied in different situations. One of these is the “National Security Act / NSA” which in Hindi is called Rasuka. This law was enacted on September 23, 1980, during Indira Gandhi’s government.

 The National Security Act (NSA) is a law in which it has been provided that if a particular threat comes from any person, then that person can be detained. If the government thinks that a person is a threat to the country, then he can also be arrested under this law.

The National Security Act (NSA) was enacted in 1980 with the aim of giving more power to the government in terms of the security of the country. This Act gives power to the government that if it feels that there is a need to arrest someone in the interest of the country, then it can also be arrested. 

In short, this act gives the right to arrest any suspicious person.

Who can be detained under the National Security Act / NSA law?

• If the government feels that a person is preventing them from performing tasks that ensure the security of the country, then he can be detained under the NSA Act.
• If the government feels that a person is obstructing the smooth functioning of law and order, the government can order him to be detained under the NSA Act.
• If the government feels that a person is preventing it from doing the work of ensuring the security of the country, then it can order that person to be arrested under the NSA Act.
•  Apart from this, if the government feels that any person is creating obstacles in front of it in running law and order smoothly, then it can order to arrest him.
• Also, if the Government finds that person obstructing the supply of an essential service, the Government can get him arrested.

• On the other hand, if the government feels that a person is living unnecessarily in the country and he is facing arrest, then the government can also get him arrested under this law.
• This law can also be used by the District Magistrate, Commissioner of Police, State Government within their limited scope.

What is the maximum punishment that can be given under the National Security Act / Rasuka Kanoon 

• Under the National Security Act / NSA law, a person can be arrested for the first three months. Then, as necessary, the period of arrest can be extended for three months each. The period cannot be extended for more than three months at a time.
• If any officer has made this arrest, then he has to tell the state government on what basis he has made this arrest. Unless the state government approves this arrest, this arrest cannot be for more than twelve days. If this officer files the reply in five to ten days, then this period can be reduced to fifteen days instead of twelve.
• If the report is approved by the state government, it has to be sent to the central government within seven days. In this, it is necessary to mention on what basis this order was issued and what is the view of the state government and why this order is necessary.
• Under this law, the suspect can be kept in custody without bail for 3 months and at the same time its period can be extended. Along with this, there is no need to frame charges for detention and the period of detention can be extended up to a maximum of 12 months.
• The person against whom the order is issued can be arrested anywhere in India.
•  Also, the detained person can appeal before the advisory of the High Court but he is not allowed a lawyer during the trial.
•  Here the state government has to tell the person to be arrested that this person has been kept in custody under the National Security Act / NSA law.
• If the grounds for arrest are proved sufficient, then the person can be kept in custody for a maximum period of one year from the period of arrest. Before the completion of the time period, neither the punishment can be terminated nor it can be changed.
